1. USER INFORMATION 

Who is responsible for processing your personal data? 

MTG PUBLIMAPS IBERICA GROUP SL is the CONTROLLER of the processing of the USER’s personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD). 

What do we use your personal data for and why do we do it? 

Depending on the form through which we obtained your personal data, we will treat it confidentially to achieve the following purposes: 

  • To attend to and manage queries, requests for information or communications made by the user and related to the services offered, through the different contact channels enabled on the website of the controller (for the legitimate interest of the controller, art. 6.1.f GDPR). 
  • To carry out statistical analyses and market studies, in order to improve services, content and communication strategies (for the legitimate interest of the controller, art. 6.1.f GDPR).
  • Location Data in the Mobile Application (SEEKU): The mobile application collects and processes precise and/or approximate location data (GPS and network) from the user’s device. This collection is strictly necessary for the app’s core functionality, enabling , for example, locating nearby services, displaying routes, etc. This location data is processed solely to provide the requested service and is never sold, shared, or disclosed to third parties for advertising or marketing purposes.

How long will we keep your personal data? 

Personal data will only be kept for as long as necessary to fulfill the purpose for which it was collected and while there is a relationship with the user. 

Once this purpose has been fulfilled, the data will be duly blocked for the legally required periods to address possible legal, administrative or contractual liabilities. 

Once these periods have ended, the data will be securely deleted, applying the appropriate technical and organizational measures to guarantee its deletion, anonymization or total destruction, so that its recovery or subsequent processing is not possible.

To whom do we provide your personal data? 

Personal data will not be transferred to third parties, except when necessary for the proper development and execution of the purposes of the processing. 

In these cases, the data may be communicated to service providers linked to communications, technical support, web hosting or digital tools, who act as data processors, with whom the CONTROLLER has signed the corresponding processing agreements and confidentiality commitments, in accordance with the provisions of current data protection regulations. 

What are your rights? 

As a user, you have the right to: 

  • Withdraw the consent given at any time, without this affecting the lawfulness of the processing based on the consent prior to its withdrawal. 
  • Access your personal data, as well as request its rectification, deletion or portability, and the limitation or opposition to its processing, under the terms provided for in current regulations. 
  • You have the right to lodge a complaint with the competent supervisory authority, in particular the Spanish Data Protection Agency (AEPD), through its website www.aepd.es, if you believe that the processing of your personal data does not comply with applicable regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER 

By checking the corresponding boxes and completing the fields indicated with an asterisk (*) in the contact or download forms, users expressly, freely and unequivocally accept that the requested data is necessary to process their request and properly provide the services offered.

Providing data in fields not marked as mandatory is voluntary. 

The user guarantees that the personal data provided to the CONTROLLER is truthful, accurate and up-to-date, and undertakes to communicate any modification that may be necessary. 

The CONTROLLER informs you that the data requested through the website is necessary for the proper handling of requests and the provision of an appropriate service. If the required information is not provided, it will not be possible to guarantee that the attention or services offered will fully meet the user’s needs. 

3. SECURITY MEASURES 

That in accordance with the provisions of current regulations on the protection of personal data, the CONTROLLER is complying with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and expressly with the principles described in Article 5 of the GDPR, by which they are processed lawfully, fairly and transparently in relation to the interested party and adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed. 

The CONTROLLER guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has communicated to them the appropriate information so that they can exercise them.

Security policy 

The CONTROLLER recognizes the importance of identifying and protecting its information assets, whether owned by the company or by third parties, preventing their destruction, disclosure, modification, and unauthorized use. To this end, our company is committed to developing, implementing, maintaining, and continually improving an Information Security Management System. 

Information security is characterized as the preservation of:

  1. a) Its confidentiality, ensuring that only those who are authorized can access the information. 
  2. b) Its integrity, ensuring that the information and its processing methods are accurate and complete 
  3. c) Its availability, ensuring that authorized users have access to the information and its associated assets when required. 

Information security is achieved by implementing an appropriate set of controls, such as policies, procedures, organizational structures, training, software, and infrastructure. These controls must be established to ensure that the specific security objectives of the CONTROLLER are met. 

The RESPONSIBLE defines and assigns all responsibilities regarding information security, with the purpose of ensuring that the information security management system complies with best practice standards. 

It is the policy of the RESPONSIBLE PARTY: 

  • Establish annual objectives related to Information Security. 
  • Develop a process for assessing and treating information security risks, and based on the results, implement the corresponding actions to address risks deemed unacceptable and ensure continuous improvement. 
  • Classify and protect information in accordance with current regulations and the criteria established by Management. 
  • Comply with service, legal or regulatory requirements and contractual safety obligations. 
  • Provide information security awareness and training to all staff. 
  • Establish that all personnel are responsible for reporting security violations, confirmed or suspected, in accordance with the relevant procedures.
  • To penalize any violation of this policy and any policy or procedure related to information security. 
  • Establish the necessary means to guarantee the continuity of the RESPONSIBLE’s operations. 

Social Media Policy 

1. USER INFORMATION 

Who is responsible for processing your personal data? 

MTG PUBLIMAPS IBERICA GROUP SL, hereinafter, the CONTROLLER, informs the USER that it has created a profile on the social networks Facebook and Instagram , that it is responsible for the processing of the user’s personal data carried out on said social networks, and informs the USER that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), and therefore provides the following information on the processing: 

Why do we process your personal data? 

Purpose of processing: To maintain a relationship between the USER and the CONTROLLER which may include the following operations: 

  • Process requests and inquiries submitted to the data controller ● Inform about activities and events organized by the data controller ● Inform about products or services offered by the data controller ● Interact through official profiles 
Why are we allowed to process your personal data? 

Legal basis for processing: Article 6.1.a GDPR, the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER’s social network, thus showing interest in the information published therein. Therefore, when requesting to follow our official profiles, the USER gives us their consent to process the personal data published on their profile. 

The USER can access the privacy policies of the social network itself at any time, as well as configure their profile to guarantee their privacy.

The CONTROLLER has access to and processes the USER’s public information, specifically their contact name. This data is only used within the social network itself and will only be added to the CONTROLLER’s file when necessary to process the USER’s request. 

How long will we keep your personal data? 

Data retention criteria: Data will be retained until the USER revokes the consent given as indicated in this privacy policy. 

Who do we share your personal data with? 

Communication of data: Information provided by the USER through the CONTROLLER’s social media accounts, including personal data, may be published, depending on the services the USER uses, and may therefore be publicly available to other social media users. From their profile on each social network, the USER can configure what information they wish to make public, view the permissions granted, and delete or deactivate them, just like any third-party application they no longer wish to use. 

No communication of personal data to third parties outside the social network is planned except, if it is essential for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and processing agreements required by current privacy regulations. 

What are your rights? 

Rights that assist the USER: They can only be satisfied in relation to that information that is under the control of the CONTROLLER. 

Right to withdraw consent at any time 

Right of access, rectification, portability and erasure of your data, and to limit or object to its processing 

Right to lodge a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations.

2. USING THE PROFILE 

The CONTROLLER will carry out the following actions: 

  • Access to public profile information 
  • Publication on the USER’s profile of all information already published on the CONTROLLER’s social network 
  • Send personal and individual messages through social network channels 
  • Page status updates that will be published on the USER’s profile 

The USER can always control their connections, delete content that is no longer of interest to them, and restrict who they share their connections with; to do this, they must access their privacy settings. 

3. PUBLICATIONS 

Once the USER follows or joins the CONTROLLER’s social network, they may post comments, links, images, photographs, or any other type of multimedia content supported by the platform. In all cases, the USER must be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of any affected third parties. 

Any publication on the social network, whether text, graphics, photographs, videos, etc., that offends or is likely to offend morality, ethics, good taste, or decorum, and/or that infringes, violates, or breaches intellectual or industrial property rights, the right to one’s image, or the Law, is expressly prohibited. In such cases, the ADMINISTRATOR reserves the right to immediately remove the content without prior notice and may request the permanent blocking of the USER. 

The CONTROLLER is not responsible for content freely published by a USER. The USER should be aware that their posts will be visible to other users, and therefore they are primarily responsible for their own privacy. Images posted on the social network will not be stored in any file by the CONTROLLER, but will remain on the social network.

4. DATA ON MINORS OR PERSONS WITH SPECIAL NEEDS 

Access to and registration through the CONTROLLER’s social media accounts is prohibited for individuals under 18 years of age. Furthermore, if the USER has special needs, the intervention of their parent or legal guardian, or their legal representative, will be required, through a valid document proving such representation. 

The CONTROLLER shall be expressly exonerated from any liability that may arise from the use of social media by minors or persons with disabilities. The CONTROLLER’s social media accounts do not knowingly collect any personal information from minors; therefore, if the USER is a minor, they should not register, use the CONTROLLER’s social media accounts, or provide any personal information.
